2. Data we collect
Information you give us
- Contact details: name, email address, phone number, mailing address.
- Property preferences: search criteria, budget, saved listings, neighborhoods of interest.
- Transaction details you choose to share, such as pre-approval status or property you wish to sell.
- Messages, form submissions, and call or appointment notes.
Information collected automatically
- IP address, device and browser type, pages viewed, referring page, and time spent.
- Data from cookies and similar technologies, only as described in Section 5.
We do not intentionally collect special categories of data (such as health, religion, or ethnicity). Please do not send us such information.
3. How and why we use your data
GDPR requires a lawful basis for every use of personal data. Ours are:
| Purpose | Lawful basis |
|---|---|
| Responding to inquiries and scheduling showings or consultations | Steps at your request before a contract (Art. 6(1)(b)); legitimate interests (Art. 6(1)(f)) |
| Providing our buying, selling, and rental services | Performance of a contract (Art. 6(1)(b)) |
| Sending marketing emails, texts, listing alerts, and newsletters | Your consent (Art. 6(1)(a)) |
| Analytics and advertising cookies | Your consent (Art. 6(1)(a)) |
| Strictly necessary cookies, site security, fraud prevention | Legitimate interests (Art. 6(1)(f)) |
| Record-keeping required by real estate, tax, and anti-money-laundering law | Legal obligation (Art. 6(1)(c)) |
We do not make decisions about you based solely on automated processing that significantly affects you.
4. Your consent
Where we rely on consent, we follow these rules:
- Freely given and specific. Consent is separate for each purpose (for example, marketing emails versus analytics). Our services are not conditional on agreeing to marketing.
- Clear action. We use unticked boxes and explicit choices. Silence, pre-ticked boxes, or continued browsing are not consent.
- Informed. At the point of collection we tell you who we are, what we will do with your data, and how to withdraw.
- Withdrawable at any time. Withdrawing is as easy as giving consent: use the unsubscribe link in any message, the cookie settings below, or email us. Withdrawal does not affect processing done before you withdrew.
- Recorded. We keep a record of when and how you consented so we can demonstrate it.
5. Cookies and similar technologies
Strictly necessary cookies keep the site working and do not require consent. All other cookies stay off until you opt in.
| Category | Purpose | Default |
|---|---|---|
| Strictly necessary | Security, load balancing, remembering your cookie choices | Always on |
| Analytics | Understand how visitors use the site so we can improve it | Off |
| Marketing | Measure ads and show relevant listings on other sites | Off |
You can change or withdraw your choice at any time by returning to this section. You can also delete cookies in your browser settings.
6. Who we share data with
We do not sell your personal data. We share it only with:
- Service providers acting on our instructions under data processing agreements: website hosting, CRM, email and text messaging, e-signature, and analytics providers.
- Transaction partners needed to complete your deal: lenders, title and escrow companies, inspectors, other agents and brokerages, and listing services, with your knowledge.
- Authorities and advisors where required by law or to protect legal rights, including our lawyers and accountants.
- A successor if our business is sold or reorganized, with notice to you.
7. International transfers
We are based in the United States, so personal data from the EU, EEA, or UK is transferred to and processed in the U.S. Where required, we rely on an adequacy decision (including the EU-U.S. Data Privacy Framework for certified recipients), Standard Contractual Clauses, or your explicit consent after being told of the risks.
8. How long we keep data
- Inquiries and leads that do not become clients: up to 24 months after last contact.
- Client and transaction records: 7 years after closing, or as long as law requires.
- Marketing preferences: until you withdraw consent, plus a minimal suppression record so we honor your opt-out.
- Analytics data: up to 14 months.
9. Your rights
Under the GDPR you have the right to:
- access a copy of your personal data;
- correct inaccurate or incomplete data;
- erase your data (“right to be forgotten”) in certain cases;
- restrict processing;
- receive your data in a portable format;
- object to processing based on legitimate interests, and to direct marketing at any time;
- withdraw consent at any time.
To use these rights, email privacy@davidsonhg.com. We respond within one month and may ask you to verify your identity. There is normally no charge. If you are unhappy with our response, you may complain to your local supervisory authority (in the EU, find yours at edpb.europa.eu; in the UK, the Information Commissioner’s Office). We would appreciate the chance to resolve your concern first.
U.S. residents in states with privacy laws may have similar rights, and we honor them on request.
10. Security
We use appropriate technical and organizational measures, including encryption in transit, access controls, and staff confidentiality obligations. No system is perfectly secure. If a breach is likely to put your rights at risk, we will notify you and the relevant authority as the law requires.
11. Children
Our website and services are not directed to anyone under 16, and we do not knowingly collect their data. If you believe a child has given us personal data, contact us and we will delete it.
12. Changes to this policy
We may update this policy. The effective date at the top shows the latest version. If we make material changes, or need new consent for a new purpose, we will tell you and ask again before relying on it.
